Where a trucking company that leases drivers is not responsible for payment of the drivers' wages and benefits, where the lessor retained sole authority to supervise, train, hire, fire, reassign and discipline the drivers, and the lease is in all respects bona fide, trucking company is not an employer of the leased drivers for purposes of having to obtain workers' compensation insurance. 2. Trucking company's insurer, Minnesota Workers' Compensation Assigned Risk Plan, cannot collect premiums for drivers the trucking company leases where the drivers were not employees of the trucking company and where insurer had no liability to provide benefits under the Minnesota Workers' Compensation Act.
